NummixTerms of Service

These Terms of Service ("Terms") are an agreement between you and Serff Webdevelopment ("Nummix", "we", "us"), based in the Netherlands, and govern your use of the Nummix mobile app, the web version at nummixapp.com, and related online services (together, the "Service"). By downloading, accessing or playing Nummix you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use online features such as accounts, leaderboards, leagues, duels and friends. If you are under the age of majority where you live, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play Nummix on devices you own or control, for private, non-commercial entertainment only. If you downloaded the app from the Apple App Store or Google Play, the store's own terms also apply, and Apple's standard Licensed Application End User License Agreement applies to App Store downloads to the extent it is not overridden by these Terms.
3. Accounts
When you first open the app an account is created for you automatically with a random display name. You can optionally link it to Sign in with Apple or Sign in with Google to sync progress across devices. You are responsible for all activity on your account and for keeping access to your linked sign-in method secure. You can permanently delete your account and associated online data at any time in the app via Profile → Delete account.
4. Fair play
Online features only work if everyone plays fairly. You agree not to:
- cheat, use automation, bots, solvers, or exploit bugs to gain an advantage;
- manipulate, disrupt or overload leaderboards, weekly leagues, duels, streaks or other online features;
- reverse-engineer, decompile, or interfere with the app, its anti-cheat validation, or our servers;
- choose a display name that is offensive, misleading, or infringes someone else's rights;
- harass or abuse other players, or use the Service for any unlawful purpose.
We may investigate suspected violations, remove scores, rename accounts, and suspend or terminate accounts that break these rules. Solve times and results may be validated server-side for anti-cheat purposes.
5. Purchases
Nummix is currently free to play, with no in-app purchases, subscriptions or advertising. If paid features are introduced in the future, they will be clearly described in the app before purchase and billed through the Apple App Store or Google Play under the respective store's terms.
6. Intellectual property
Nummix — including its name, logo, artwork, design, puzzles, code and other content — is the intellectual property of Serff Webdevelopment and is protected by copyright and other laws. These Terms do not grant you any ownership rights. You may share screenshots, results and gameplay of Nummix (for example on social media or in videos), including for monetized content, as long as you don't misrepresent your affiliation with us.
7. Availability and changes
We work hard to keep the Service running, but online features (leaderboards, leagues, duels, syncing, notifications) are provided without any uptime guarantee and may be interrupted for maintenance or due to circumstances beyond our control. We may update, change or discontinue features of the Service at any time. If we ever discontinue the Service entirely, we will make reasonable efforts to announce this in advance in the app or on this website.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms (in particular the fair-play rules), where reasonably necessary to protect the Service or other players, or if required by law. Sections 6, 9 and 10 survive termination.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by applicable law. Nothing in these Terms limits any rights you have as a consumer under mandatory law in your country of residence.
10. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, progress, scores or streaks, arising from your use of (or inability to use) the Service. Nothing in these Terms excludes or limits our liability for intent or gross negligence, or any other liability that cannot be excluded under applicable law.
11. Privacy
How we handle your data is described in our Privacy Policy, which forms part of these Terms.
12. Changes to these Terms
We may update these Terms from time to time, for example when we add new features. We will update the date at the top of this page and, for significant changes, notify you in the app or on this website. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law in your country of residence provides otherwise. Nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence.
